Resolution Focused Approach in Family Law: The Better Approach
The family law system is designed for parties to resolve their matter if possible.
Parties are required under the Rules to negotiate, make genuine offers attend mediation and
continue exploring settlement all the way to a final hearing.
An offer of settlement in writing may later be used to seek that the other party pay your costs.
A resolution-focused approach can narrow the issues, reduce expense and stress, and improve outcomes,
even if the matter ultimately proceeds to hearing. Using such approach and seeking the most likely outcome
a Judge will deliver, is a clever tactic even in the most litigious matter that reaches a final hearing because it
would normally be the most attractive alternative to the Judge.
